DECLARATION ON THE TRIPS AGREEMENT AND PUBLIC HEALTH
TRIPS협정과 공중 보건에 관한 선언

1.    We recognize the gravity of the public health problems afflicting many
developing and least-developed countries, especially those resulting from HIV/AIDS,
tuberculosis, malaria and other epidemics.
1. 우리는 특히 HIV/ 에이즈, 결핵, 말라리아와 다른 유행병의 발생으로부터 생기는 많은
개발도상국과 최빈국을 괴롭히고 있는 공중 보건 문제의 중대함을 인정한다， 

2.    We stress the need for the WTO Agreement on Trade-Related Aspects of
Intellectual Property Rights (TRIPS Agreement) to be part of the wider national and
international action to address these problems.
2. 우리는 TRIPS 협정에 대하여 WTO 협정이 이러한 문제를 제기하는 보다 광범위하고
국제적인 행동의 일부분이 될 필요성에 대해 강조한다. 

3.    We recognize that intellectual property protection is importantfor the
development of new medicines.  We also recognize the concerns about its effects on
prices.
3. 우리는 지적 재산권 보호가 신약 개발에 있어 중요하다는 것을 인정한다. 우리는 또한
가격에 의한 효과에 대한 염려역시 인정한다. 
 
4.    We agree that the TRIPS Agreement does not and should not prevent Members
from taking measures to protect public health.  Accordingly, while reiterating our
commitment to the TRIPS Agreement, we affirm that the Agreement can and should be
interpreted and implemented in a manner supportive of WTO Members' right to protect
public health and, in particular, to promote access to medicines for all.
4. 우리가 TRIPs 협정이 공중 보건을 보호하기 위한 조치를 취하는 것을 방해하지 않으며
방해 할 수 없다는 것에 동의한다. 따라서 TRIPs 협정에 대한 우리의 서약을 되풀이하며
우리는 협정이 공중 보건을 보호하기 위한 특히 의약품에 대한 접근성을 촉진하기 위한
WTO 회원국들의 권리를 지지하는 방식으로 해석되어야 하며 이행되어야 한다고 단언한다.


In this connection, we reaffirm the right of WTO Members to use, to the full, the
provisions in the TRIPS Agreement, which provide flexibility for this purpose.
이와 관련하여, 우리는 이러한 목적을 위한 유연성을 제공하는 TRIPs 협정의 규정을  WTO
회원국들이 충분히 사용할 수 있다는 권리를 재확인한다. 

5.    Accordingly and in the light of paragraph 4 above, while maintaining our
commitments in the TRIPS Agreement, we recognize that these flexibilities include:
5. 따라서 위의 4.의 관점에서 TRIPs 협정에 대한 우리의 서약을 유지하면서 우리는
이러한 유연성이 다음과 같은 것을 포함한다는 것을 인정한다:  

(a) In applying the customary rules of interpretation of public international law,
each provision of the TRIPS Agreement shall be read in the light of the object and
purpose of the Agreement as expressed, in particular, in its objectives and
principles.
공중 국제법 해석의 습관적인 규칙을 적용할 때 TRIPs 협정은 특별히 그 목적과 원리에서
표현된 것처럼 협정의 목적과 목표의 관점에서 독해되어야 한다.  

(b) Each Member has the right to grant compulsory licences and the freedom to
determine the grounds upon which such licences are granted.
각 회원국은 강제실시권을 허가할 권리가 있으며 이러한 실시권이 허가될 수 있는 영역을
자유롭게 결정할 수 있다. 

(c) Each Member has the right to determine what constitutes a national emergency or
other circumstances of extreme urgency, it being understood that public health
crises, including those relating to HIV/AIDS, tuberculosis, malaria and other
epidemics, can represent a national emergency or other circumstances of extreme
urgency.
각 회원국은 국가적 응급상황 또는 극도의 비상상태의 상황 구성을 결정할 수 권리가
있다.  이것은 HIV/AIDS, 결핵, 말라리아와 다른 유행병과 관련되는 공중 보건 위기가
국가 응급상황 또는 극도의 비상상태상황을 나타낼 수 있다는 것으로 이해될 수 있다. 

(d) The effect of the provisions in the TRIPS Agreement that are relevant to the
exhaustion of intellectual property rights is to leave each Member free to
establish its own regime for such exhaustion without challenge, subject to the MFN
and national treatment provisions of Articles 3 and 4.
지적 재산권의 소진과 관련되는 TRIPs 협정 규정의 효력은 각 회원국들에게 제 3조와 제
4조의 최혜국과 내국민 대우 규정에 대한 위반없이 소진의 체계를 확립할 자유가 있다는
것을 일임하는 것이다. 

6.    We recognize that WTO Members with insufficient or no manufacturing
capacities in the pharmaceutical sector could face difficulties in making effective
use of compulsory licensing under the TRIPS Agreement.  We instruct the Council for
TRIPS to find an expeditious solution to this problem and to report to the General
Council before the end of 2002.
6. 우리는 제약부문의 제조기술이 불충분하거나 제조기술이 없는 WTO회원국들이 TRIPs
협정하의 강제실시권의 효과적인 사용의 어려움에 직면했다는 것을 인정한다. 우리는
TRIPs 이사회에서 이러한 문제의 신속한 해법을 찾아 2002년이 끝나기 전에 일반이사회에
보고하기를 명령한다. 

7.    We reaffirm the commitment of developed-country Members to provide incentives
to their enterprises and institutions to promote and encourage technology transfer
to least-developed country Members pursuant to Article 66.2.  We also agree that
the least-developed country Members will not be obliged, with respect to
pharmaceutical products, to implement or apply Sections 5 and 7 of Part II of the
TRIPS Agreement or to enforce rights provided for under these Sections until 1
January 2016, without prejudice to the right of least-developed country Members to
seek other extensions of the transition periods as provided for in Article 66.1 of
the TRIPS Agreement.  We instruct the Council for TRIPS to take the necessary
action to give effect to this pursuant to Article 66.1 of the TRIPS Agreement.
우리는 제66.2조에 따르는 최빈국에게 선진국이 그들이 사업과 제도의 기술이전을 촉진할
수 것이라는 선진국의 서약을 재확인한다. 우리는 TRIPs 협정의 제 66.1조에 서술된
최빈국의 이행 기간의 확장 권리에 대한 침해없이 최빈국이 TRIPs 협정의 Part 2의
section 5, 7를 이행하거나 적용하는 것과 그러한 권리를 강화하는 것을 2016년 1월
1일까지 따르지 않을 수 있다는 것에 동의한다. 우리는 TRIPs 이사회가 TRIPs 협정 제
66.1조에 따르는 효력에 대한 필요한 조치를 취할 것을 명령한다.
